1. Consent to Communications
By creating an account, submitting information, or otherwise using the Platform, Users consent to receive communications from Off Mkts, its affiliates, its service providers, and authorized marketplace participants relating to opportunities, referrals, marketplace participation, listings, customer support, transactions, legal notices, security matters, product updates, and Platform operations.
2. Communication Channels
Communications may be delivered through:
- Email;
- SMS / text message;
- Telephone (including voice calls);
- Platform messaging;
- Push notifications;
- Artificial Intelligence Systems and automated communication systems; and
- Future communication technologies permitted by law.
Users consent to the use of automatic telephone dialing systems, prerecorded or artificial voice messages, and automated text messaging where used, to the extent permitted by applicable law. Consent to marketing communications is not a condition of any purchase.
3. Message Frequency and Rates
Message frequency may vary based on account activity and marketplace participation. Message and data rates may apply depending on the User’s mobile carrier and plan. Off Mkts is not responsible for charges imposed by a User’s carrier.
4. Opt-Out and Withdrawal of Consent
Users may withdraw consent to non-essential communications at any time by:
- Replying STOP to a text message to opt out of SMS;
- Using the unsubscribe link in a marketing email;
- Adjusting notification preferences in account settings; or
- Contacting Off Mkts using the contact information below.
Even after opting out of marketing communications, Off Mkts may continue to send transactional, account, security, legal, and other non-promotional communications reasonably necessary to operate the Platform and comply with applicable law.
5. Records of Consent
Off Mkts may maintain records of communication preferences, acceptance records, opt-in records, opt-out records, timestamps, IP addresses, device information, user agent information, and accepted document versions to demonstrate consent and compliance. Electronic acceptance of this Disclosure constitutes a legally binding acknowledgment and consent.

Off Mkts may update this Disclosure from time to time. Updated versions may be communicated through website postings, account notifications, email communications, Platform messages, or other reasonable methods. The “Last Updated” date shall reflect the effective date of the most recent revision. Continued use of the Platform following an update constitutes acknowledgment of the revised Disclosure to the fullest extent permitted by law.
